This collection is a subgroup of the Montana Public Service Commission records, RS 501. This collection was not originally processed separately by Division - it contains records of multiple PSC Divisions and its predecessor agency, the Board of Railroad Commissioners. Please see the primary finding aid for more Montana Public Service Commission records. The records primarily consist of quarterly earnings reports from motor carriers regulated by the Transportation Divison. There are also orders issued by the commission and one year of minutes from commission meetings.

The Montana Public Service Commission is a five person quasi-judicial board responsible for the regulation of energy, telecommunications, water/sewer, transportation, and pipeline utilities in the state. Each commissioner is elected to a four-year term and is limited to serving two terms in any 16-year period. Each commissioner represents a specific district within the state and must be registered to vote in that district. The commissioners elect a chair and vice-chair from among the five of themselves.

The Commission is the successor of the Montana Board of Railroad Commissioners, which was established in 1907. The initial purpose of the Board was to set rates and establish regulations governing freight and passenger transportation within the state. In 1913 the Board of Railroad Commissioners was made the ex officio Public Service Commission which extended its authority to the regulation of public utilities. The current Commission and its structure were created in 1971, when the second constitution was written. The Board continued to function in this way until the 1970’s. At this time the Public Service Commission became the primary organization and the Board of Railroad Commissioners’ initial responsibilities were absorbed by the Commission.

The creation of the Commission is addressed in the Montana Code Annotated under 69-1-102 which reads "A public service commission is hereby created, whose duty it is to supervise and regulate the operations of public utilities, common carriers, railroads, and other regulated industries listed in this title. Such supervision and regulation shall ne in conformity with this title." If a vacancy on the commission should arise, the governor has the authority to fill the vacancy by appointment. The appointee will serve as a commissioner until the next general election and a new commissioner is elected.

The commissioners rely heavily upon the staff of the Commission in writing opinions due to the complex nature of utilities and the need to balance the concerns of the public with the ability of the utility providers to make enough of a profit to give them an incentive to provide adequate service for customers. As of 2025, the Commission has three separate divisions: Legal, Regulatory, and Centralized Services.

This collection consists of records collected and created by the Montana Public Service Commission and the Montana Board of Railroad Commissioners. The records primarily document the activities of what is now the Transportation Division, but was previously the Board of Railroad Comissioners. These activities include collecting quarterly income reports from motor carriers and conducting hearings regarding transportation related issues. The remainder of the records consist of minutes from the Public Service Commission meetings for the entire year of 1978. Materials include minutes, reports, and legal filings.

Series I, Quarterly Reports is arranged by the assigned Public Service Commission number for the entity. Series II, Transportation Division Dockets, is arranged by docket number. Series III, Minutes, is arranged chronologically.

Processing Note

In 2024, the various collections of the Montana Public Service Commission were integrated under one collection identifier, RS 501, in order to help facilitate access, reduce redundancy in the Montana Historical Society Library & Archives catalog, and to follow best archival practices.

Collections from Montana Public Service Commission's various Divisions and Predecessor Agencies that were previously treated as separate entities are now integrated into this collection, RS 501. Rather than reprocessing over 80 linear feet of PSC materials, MTHS staff decided to keep the past arrangement of those collections/finding aids and provide access to them via links in the primary finding aid. This decision has allowed the MTHS archival staff to maintain intellectual control over the collection, while removing the need to reprocess it. It also keeps State Agency finding aids at manageable sizes. Please read the scope and content note carefully to determine if this subgroup pertains to your research needs.
