Historical Note
The lawsuit was filed by Col. William Roger’s caretaker and long-time friend against the trustees of the William C. Rogers Trust and the University of Wyoming Foundation, as a major charitable beneficiary of the trust. The University was represented by Gregory C. Dyekman of Dray, Dyekman, Reed, and Healey, P.C. law firm. The suit challenged the validity of the trust amendment that was done late in Col. Roger’s life and argued that the caretaker and friend should have received a greater share from the trust. Judge Jeffrey Donnell entered summary judgement in the case against the plaintiffs and in favor of the validity of the trust and the rights of the University of Wyoming Foundation to receive its beneficiary shares under that trust. The case was appealed to the Wyoming Supreme Court, which upheld Judge Donnell’s decision unanimously.
