Established: By the 1889 Constitution of the State of Montana.

Functions: The general supervision of the public schools and district of the state. Responsibilites include: teacher certification; state school law enforcement; school districts' budget oversight; curriculum and text standardization.

Predecessor Agency: Department of Public Instruction

In 1864, two years before the first school district was organized in Virginia City, Montana Territory, the position of school commissioner was created with the responsibility of reporting to the governor on matters relating to education in the territory. The office remained until the 1872 Montana Territorial Assembly passed a school law which provided that the guidance of the territory's schools be placed under a superintendent of public instruction. Governor Potts appointed Cornelius Hedges as the first territorial superintendent.

The Office of Superintendent of Public Instruction was re-established after statehood in 1889, and the Superintendent of Public Instruction was created as an elected position. At the same time, the 1889 Montana Constitution placed the newly created state's higher education system under the direction of the State Board of Education, composed of the superintendent of public instruction, the governor, the attorney general, and eight other members appointed by the governor. The State Board of Education was made responsible for the determination of educational programs and policy, preparation of budgets, financing of current operations, personnel administration, and planning and financing of physical facilities.

In 1959, the Montana Legislative Assembly created the Department of Public Instruction with the Superintendent of Public Instruction serving as chief administrator "for the purpose of the staff and administration of the duties and services of the superintendent of public instruction." In 1977 the name of the agency was changed to the Office of Public Instruction.

This record group consists of materials created by the Office of Public Instruction, the various divisions and departments that comprise that state agency, and by employees of the agency working in their official capacity as Montana state employees. These records reflect the breadth of the day-to-day concerns of the Office of Public Instruction as well as those of county superintendents. The bulk of the materials were generated by the Office of the Superintendent of Public Instruction, as well as the Certification and Licensure Division.

The records contain a significant amount of correspondence between the Superintendent of Public Instruction and various county superintendents as well as correspondence to and from other agency employees. Topics represented in this collection cover a wide range of educational matters including: Indian education; distance education; school board-teacher relations; vocational and technical training; school bus transportation; religious schools; school district funding and school land issues; county superintendent concerns; school nutrition programs; and matters related to gender, sexuality, and sexual harassment.

Additional materials in this record group include department bulletins and newsletters, reports to and from the Superintendent, research and training materials for school district workshops, financial statements, and photographs.

Historical Note: The Office of the Superintendent of Public Instruction is an elected executive position in the state of Montana. The Superintendent oversees primary and secondary schools in the state, and their responsibilities include teacher certification; enforcing state school laws; equalizing school districts' budgets; overseeing higher and vocational education institutions; and standardizing basic curriculum and texts. The Superintendent also serves on the State Board of Land Commissioners and the State Board of Public Education.

Content Description: The records in this series consist of materials generated by individual Superintendents of Public Instruction in their capacity as head of the Office of Public Instruction, as well as by reason of their membership on the State Board of Land Commissioners, the Board of Education, and other duties. The series is comprised mainly or correspondence. A wide range of educational matters are represented in this series including school nutrition, transportation, school consolidation, Indian education, Hutterite and other religious schools, school district funding, and concerns of individual county superintendents, as well as gender equity and sexual harassment training. Other materials include speeches, reports, newsletters, and financial records.

Arrangement: This series is divided into 12 subseries, each representing a different superintendent's administration; thereunder, chronological as possible.

Processing Note: The materials in this series were originally processed as the Financial Support for Schools Educational Program records (RS 172), Department of Basic Instruction records (MM 19), School Construction records (RS 340), and Office of Public Instruction records (RS 473 and RS 489). In 2021, those materials were integrated into RS 102 and combined as a single series to facilitate better access.

Historical Note: In 1895, County Superintendents of Instruction, under the State Superintendent of Instruction's supervision, were required by law to hold public examinations for teacher certification. In 1913, a State Board of Educational Examiners was created to provide rules for issuing teachers' certificates, prepare the certification exam, and oversee its grading. In 1949, the board was abolished, and these duties were transferred back to the Superintendent of Public Instruction. In 1972, the Board of Public Education assumed responsibility for the implementation of the teacher certification system. The Board also considers the suspension or revocation of teacher certificates and hear appeals from the denial of teacher certificates.

Content Description: Records consist of certification payments records, teacher data lists organized by school district, an alphabetical index to teacher certifications, as well as teacher certification files.

Access Restrictions: Teacher certification files are restricted due to privacy concerns. Researchers wishing to access the names of teachers and courses they took or other non-restricted information in these files should contact the archivist for more information.

Arrangement: The microfilm is organized in the order the reels were produced. Usually this means chronological order, but due to the way it was filmed, there are many inconsistencies. Records from the 1960s and early 1970s are not present. The microfiche is arranged by license numbers 3 - 4074, but many licenses within that range are not represented.

Processing Note: The materials in this series were originally processed as the Montana Teacher Certification records (RS 165), as well as the Montana Teacher Certification records (SMF 53 and SMFiche 25). In 2021, those materials were integrated into RS 102 and combined as a single series to facilitate better access.

Series 4:  Conservation Education Division, 1945-1966Return to Top

Historical Note: In 1951, the Montana Legislative Assembly enacted a law authorizing a continuing program of conservation education in public elementary and high schools. The program was implemented in 1957 when the Conservation Education Division was established, through a grant from the Montana Fish and Game Commission. Frank Dunkle administered the program, and over a two-year period, he developed study guides and conducted teacher institutes throughout the state. The program expired in August 1959, when the funds were not renewed.

Content Description: These records consist mainly of materials produced by Frank Dunkle regarding the creation and implementation of the conservation education program.

Series 5:  State Correspondence School, 1939-1958Return to Top

Historical Note: The State Correspondence School was established by the 1939 Legislative Assembly to serve eighth-grade graduates who could not attend high school due to physical disability, geographic remoteness, or lack of specific classes at their local high school. In 1951, the program was expanded to include non-citizens seeking citizenship training and elementary school students; and in 1959 to include prison inmates. The school was closed around 1960.

Content Description: These records consist of general correspondence between the head of the school and the Superintendent of Public Instruction and a scrapbook of clippings. There are also student course completion records, listing each student's name, course taken, and grade received.

Access Restrictions: The student course completion records are restricted due to FERPA. Researchers wishing to access the names of students and courses they took should contact the archivist for more information.

Series 6:  Vocational and Adult Services Division, 1918-2000Return to Top

Historical Note: Montana's vocational education program began in 1918 with the establishment of the State Board for Vocational Education. The following year the legislature adopted "An Act to Accept the Terms and Provisions of the Federal Act Giving Aid to the Several States for Vocational Education..." The program was administered under the State Board of Education and overseen by the Superintendent of Public Instruction. In 1947, the program became the Bureau of Vocational Rehabilitation. In 1961, the functions were split as the Division of Vocational Education and the Division of Vocational Rehabilitation.

Another aspect of vocational education fell under the Supervisor of Business and Office Education—a position that was established in 1946 under Department Superintendent of Public Instruction. The program operated under numerous different names and organizational structures, including Distributive and Office Education, Business and Distributive Education, and Distributive Education Services. The term "distributive education" referred to marketing, merchandising, and management education.

With the creation of the Montana Council on Vocational Education in 1985 to comply with the Carl D. Perkins Vocational Education Act of 1984, the division became the Vocational and Adult Services Division. It was later renamed the Career, Technical and Adult Education Division.

Content Description: The records in this series consist of financial records, including budgets, National Youth Administration and National Defense Training Program ledgers, annual financial and statistical reports, and program materials for vocational and business education including agriculture, home economics, and office skills. The records also consist of correspondence to and from the Superintendent of the Office of Public Instruction, county superintendent's and supervisors for the Division of Vocational Education and Division of Business and Office of Education.

Historical Note: The 1955 Legislative Assembly enacted a law providing for the creation of special classes for mentally and physically handicapped children in public schools. A Supervisor of Special Education was hired to advise and provide encouragement, information, and assistance to local schools in establishing program. In 1965 the law was amended to formalize guidelines for eligibility, etc. The provision of special classes remained optional with each school district until the early 1970s.

The Special Education Advisory Panel was created in 1977 to provide policy advice to the Montana Superintendent of Public Instruction with respect to special education and related services for children with disabilities.

Content Description: The records in this series consist of general correspondence to and the Supervisor of Special Education with school districts and individuals within school districts concerning the establishment of programs for special education, eligibility of students, transportation, financing, etc. There is also a small amount of correspondence with the Montana Association for Retarded Children and Adults and other organizations.

These materials also include organizational records such as advisory panel minutes, handouts, membership lists, by-laws, and correspondence of the Special Education Advisory Panel.

Arrangement: This series is divided into 2 subseries: one for materials created by the Supervisor of Special Education and one for materials created by the Special Education Advisory Panel. Materials in both subseries are organized chronologically when possible.

Historical Note: The Montana Office of Public Instruction (OPI) Legal Division provides legal advice and services to the Superintendent of Public Instruction and assists with appeals from county superintendent decisions. The Division represents the State Superintendent and OPI in court proceedings, provides legal services and advice in connection with teacher certification, denial, suspension, and revocation, and assists with the adoption and amendment of administrative rules. In addition, the Division assists with legislation and produces School Laws of Montana.

Content Description: The materials in this series consist of the case files of the Montana Office of Public Instruction Legal Services Division. Records include State Superintendents' decisions regarding county superintendent appeals, an appeal to the State of Montana regarding vocational education; miscellaneous gender equity cases brought by Nancy Deden, Lee Curtis, and others against the Montana High School Association and the Office of Public Instruction; Karyn Ridgeway v. Montana High School Association; Helena Elementary School District et al. v. State of Montana et al; and other miscellaneous cases.
