Summary
Records (1867-1889) of the territorial executive offices consist of correspondence; financial records; oaths of office; treaties with the Bannack, Shoshone, and Sheepeater Indian tribes; reports of the insane asylum, the superintendent of schools, and various territorial agencies; and miscellany. Records (1889-1975) of the state executive offices consist of correspondence; departmental regulations; financial records; legal documents, including construction contracts for the state capitol and various state institutions, township descriptions; reports and inventories of state agencies; and miscellany, including automobile registration registers, a petition of John W. Darnell for release from a mental hospital, railroad licenses, and other matters. There are also subgroups for the Building and Loan Commission, the Capitol Site Commission, the Board of Charities and Reform, the Efficiency and Trade Commission, the State Board of Examiners, the Fish and Game Commission, the Law Library, the Railroad Commission, the Department of Weights and Measures, and the Board of World's Fair Managers.

Historical NoteReturn to Top

The Montana Territorial Secretary, authorized by the Organic Act of The Territory of Montana, was a presidential appointee whose duties included the transmittal of federal reports, and serving as Territorial Governor in the latter's absence. With the adoption of the 1889 Montana State Constitution the Office of the Secretary of State replaced the Territorial Secretary. The new Secretary was elected to a four term and assigned a variety of new tasks including serving as ex-officio member of various boards and commissions. The Secretary currently serves as a member of the State Board of Examiners, Board of Trustees of the Law Library, Board of Land Commissioners, and the Board of Prison Commissioners. In addition he or she serves as president of the House of Representatives; chief election officer overseeing procedures and publications relating to state elections; state corporations officer overseeing incorporation documentation for foreign and domestic businesses; custodian of records affixing his seal to and filing official documents handled by the Governor's Office; and central filing officer for the Uniform Commercial Codes, notary bonds, deeds, mortgages, motor vehicle registration, and trade marks.

This collection consists of thirteen subgroups relating to the duties of the office of Territorial Secretary and its successor the Secretary of State.
